I'm glad you mentioned how insane it is that Harry Potter used a literal sword to stab a living creature and that's fine but casting a spell that does the same thing is "dark". Also there are spells that shoot fire or whatever that could obviously horribly kill someone but that's not dark magic, it's just fine. Is a real gun to gun spell as a real sword is to sword spell? Who knows!
